The following terms and conditions apply to your order at Euroorchid.com
1. The following terms and conditions apply to all Euroorchid.com transactions. The terms and conditions are available to all and can be found on our web site.
2. Euroorchid only uses personal information for correct processing of orders and for promotional purposes (after having obtained your approval to receive updated information to from Euroorchid.com). This information will be stored in an area that is not publicly accessible.
3. You agree to provide honest and accurate personal information and also to edit and update this information as necessary. If the information you provide is found to be incorrect or incomplete Euroorchid reserves the right to cancel your order.
4. Euroorchid works in partnership with the TPG Post Package service for the shipping of products and services.
5. Intellectual and industrial property rights relating to Euroorchid.com and her Internet site, including the programming, texts and photos remain by Euroorchid.com. It is forbidden to change, make public, multiply and/or edit the information presented on Euroorchid.com without written permission from Euroorchid. Euroorchid.com cannot guarantee that the delivered products and or services do not infringe on any (unwritten) intellectual and/or industrial copy righs of thrid parties.
6. Euroorchid.com delivers throughout Europe.
7. The prices listed for the products and services offered are in Euros, including VAT, excluding shipping costs. Changes in prices, corrections en typing errors restricted.
8. A contract is only made after you have agreed to pay.
9. You have the right to dissolve or cancel your Euroorchid order, if your request for cancelation or dissolution is made at least 48 hours before the send date. In such cases Euroorchid.com reimburses you the cost of the purchase or order after deducting the handling fees relevant to your chosen payment methods for the order(s) in question. For items or services which are on "sale" the request for dissolution of the purchase or cancelation of the order is not applicable.
10. Orders are not processed in the weekend and/or on public holidays; your order will be processed on the first following workday. Please keep this in mind. If you still place an order in the weekend and/or on a public holiday Euroorchid.com will process your order on the first following workday.
11. Deliveries to hospitals, nursing homes, hotels, restaurants, camping sites, offices etc., are placed completely at your own risk and cost, given that these organisations often have their own policies and procedures regarding receipt of orders.
12. In case of damage or disappearance of goods during transport, Euroorchid.com ensures that a new product will be delivered as soon as possible, providing you have stated goods receipt, detailed the missing product and signed the delivery note. If this is not done, then you are not entitled to any replacement or compensation of damaged goods.
13. If after closing the contract a delivery cannot be made in conformity with the agreement, Euroorchid.com will inform you of this as quickly as possibe by telephone, fax and/or e-mail, without being held responsible for reimbursement or damages of any kind. In case of unforeseen circumstances Euroorchid.com can, in consulation with you, agree to cancel the contract or delay delivery, until the situation is regularised. In case of cancelation of the contract due to unforeseen circumstances Euroorchid.com will re-imburse you for the amount paid. The following situations fall under unforeseen circumstances: obstructive government policies; total or partial striking or disturbance of the internal and external transportation infrastructure ; riots and other irregularities which temporarily hinder the execution of the contract ; total or partial stagnation of the production process and/or personnel strikes or lock-outs in, the company or in the services relating to goods or primary materials.
14. Since flowers and plants are fresh products, Euroorchid can't honour or provide a time limit in which you can, without providing a reason, dissolve an order after receiving the product in question.
15. Euroorchid cannot be held accountable for the information which appears on this site. This information is striclty for informative purposes.Euroorchid.com cannot in any way be held accountable for volledigheid, text- en typing errors and other incorrect information which may appear on this site.Euroorchid.com cannot held accountable for eventual consequence of the use of products and /or services described or offered on this site.
16. Dutch law is apllicable to these terms and conditions. All disagreements which may arise as a result of these terms and conditons or of the possible resulting contracts will in the first instance exclusively be brought before a competent judge in The Hague, unless otherwise stated to the contrary.
17. The guarantee lasts from delivery until the box has been opened, not after the plant has been lifted out and subject to damage.
18. Euroorchid BV cannot be held responsible in case nobody is home when the local post-company offers the package to the delivery address, so that the delivery will be delayed or the package will be returned.
19. Euroorchid BV cannot be responsible in case we did not receive a complete or correct address, so that the delivery will be delayed or the package will be returned.
